As Ms Black admitted the breach we found the charge proved.

Penalty:

Taking into account upcoming riding commitments Ms Black is suspended from the close of racing on Saturday December 13th up to and including racing on December 26th. Race days in this period are:

20/12/14 Manawatu
21/12/14 Gore
26/12/14 Otago

Facts:

Following the running of Race 2, Racing News @theinformant.co.nz PREMIER, an information was lodged by Mr N Goodwin alleging a breach of Rule 638(1) (d) in that rider R Black permitted her mount LETS DIVORCE to shift outwards when not sufficiently clear of TEQUILA SUNRISE which was crowded before being checked near the 300 metres.

Ms Black is an apprentice rider from Riverton who was assisted in the hearing by Mrs Zimmerman. At the beginning of the hearing Ms Black confirmed she understood the nature of the charge and that she admitted the breach.

Mr Oatham highlighted the incident using all the available films. Turning into the home straight Ms Black angled her mount out when looking for clear running but in doing so caused interference to Mr Colgan (TEQUILA SUNRISE) who was racing in a position outside and slightly behind. The initial movement only resulted in Mr Colgan being crowded for several strides but Ms Black continued to move out into his line which forced him to check his mount to prevent clipping heels.

Ms Black explained that both she and Mr Colgan were tracking horses into the home straight and, in her opinion, both of them moved off line to take the same gap at the same time. She said she was half in front of Mr Colgan and was travelling the better. Mrs Zimmerman said she thought it was probably a case of competitive riding but maybe Mr Colgan’s mount was more entitled to the gap.

Submissions for Penalty:

Mr Goodwin asked Ms Black to confirm that she had not been charged with careless riding this year. She said that was correct however she was unsure when her last careless riding charge had been. Mr Goodwin submitted that Ms Black had a very good record, the breach was in the mid to just below mid-range and that a term of suspension was an appropriate penalty.

Ms Black said she gets approximately five rides each race meeting and rides throughout the South Island. This was her second trip to ride in the North having ridden at Awapuni a few weeks ago. She advised of riding commitments over the next seven days.

Reasons for Penalty:

In coming to a decision on penalty the committee took into account all of the submissions and adopted as a starting point a period of five days suspension. It was our opinion that Mr Colgan suffered quite severe interference and it occurred at a crucial stage of the race just as he was mounting a run to go through a gap. While it is not possible to predict where Mr Colgan may have finished, had he been afforded a clear run, the actions of Ms Black denied him that opportunity in a $30,000 race. We therefore added one day to our starting point.

Mitigating factors were Ms Black’s admission of the breach and her excellent record for which we have given credit. Balancing up all the factors it was our opinion that a four day suspension was an appropriate penalty.
