Facts:
This protest followed the running of Race 6 at Rotorua. Mr Mulcay alleged that GERSHWIN 'broke in excess of 150 metres during the running'.
Mr Paynter, representing the horse's connections, noted on the Information that:
(a) He did not contest the protest, and
(b) He did not wish to be present.
Submissions for Decision:
Mr Mulcay identified GERSHWIN at about the 1050 metres mark when the horse went off stride. GERSHWIN continued on at a gallop for at least 350 metres and eventually regained its gait and finished 5th. As it was in breach of the Rule and Regulations Mr Mulcay asked that the horse be disqualified from the race.
Reasons for Decision:
The protest was not contested.
Rulr 870(3) states 'Any horse which breaks from its gait shall promptly regain its proper gait'.
The Regulations provide that 'Any horse which breaks from its gait either at the start or during the running of any race and continues on in the break for a distance of 150 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to regain its proper gait.'
