We have a discretion to exercise as to whether to disqualify MISS KATHRYN. In light of the distance over which MISS KATHRYN has failed to regain its gait we exercise this discretion and disqualify that horse from 5th placing.

Amended placings are:

1: 8, BUTE FALCON
2: 9, HOT TODDY
3: 10, PURE VOGUE
4: 3, EVES APPLE
5: 1, JUNKYARD SU

Facts:

This was a protest by Mr Wallis, stipendiary steward, against horse number 4, MISS KATHRYN, placed 5th by the Judge, on the ground that the horse broke at the start and failed to settle and was in its incorrect gait in excess of 150 metres.

Judges placings were:

1: 8, BUTE FALCON
2: 9, HOT TODDY
3: 10, PURE VOGUE
4: 3, EVES APPLE
5: 4, MISS KATHRYN
6: 1, JUNKYARD SU

Submissions for Decision:

Mr Wallis had Mr Allison demonstrate the incident. The videos showed that MISS KATHRYN broke free of interference after the start and galloped in excess of 150 metres.

Mr Holmes, the driver of MISS KATHRYN indicated on the information that he did not contest that MISS KATHRYN should be disqualified.

Reasons for Decision:

We have viewed the incident on the videos and are satisfied MISS KATHRYN broke free of interference immediately after the start and galloped for at least 180 metres. This is in excess of the distance of 150 metres that is referred to in the breaking horse regulations as offering guidance to a Committee as to when a horse has failed to promptly regain its gait.
