Following the running of race 4 the Northstar Hotel and Restaurant 1200m stewards charged Mr Z Bholah (FLICKA OF GOLD) with a breach of excessive use of the whip in that he “…used his whip excessively prior to the 100m.”
Rule 638 (3) (b) (ii) reads: A Rider shall not:
(b) strike a horse with a whip in a manner or to an extent which is:
(i) unnecessary (ii) or excessive (iii) or improper
The guidelines read: Without affecting the generality of Rule 638(3)(b), a rider may be penalised if their whip use is outside of the following guidelines: Inside the final 600 metres of a race, official trial or jump-out a horse may be struck with the drawn whip up to five times after which the rider must cease their use of the whip for a minimum of five strides before striking the horse again with the drawn whip, with this restriction to apply prior to the final 100 metres. The whip may then be used at the rider’s discretion until the winning post is reached.
Mr Bholah admitted the breach and appeared at the hearing assisted by Mr Tyler.
Mr McLaughlin, with the aid of the video replays pointed out the position of FLICKA OF GOLD as the field rounded the home turn. He said FLICKA OF GOLD was about four wide at the rear of the field at the 350m mark. Mr Bholah was seen to use his whip 21 times between the 350m and 100m marks without a break. He said the use of the whip was continuous and a breach of the rule.
Mr Tyler stated while Mr Bholah’s whip use was excessive in the number of strikes, none of them were punishing. Mr Bholah stated he was just trying to do his best and had made a mistake.
Submissions for Penalty:
Mr Wadley stated that Mr Bholah was an apprentice jockey with limited opportunities. The JCA Penalty guide recommended a starting point of $300 for a first offence. However, given the high number of strikes with the whip and no respite over a distance of 200m he sought a fine of $400. Mr Bholah had no previous charges under this rule.
Mr Bholah stated he had had four of five rides last season. He had two rides today being the first rides for this season. He would prefer a fine as opposed to a suspension.

Mr Bholah was charged with excessive use of the whip outside the final 100m, in that he struck his mount continuously without the required breaks. The number of strikes, 21, is at the high end of the scale. The standard penalty for a first breach of the rule is a starting point of $300 as per the recommendation of the Penalty Guide. Due to the high number of strikes we increase the starting point to $400. Mr Bholah is given credit for his early guilty plea, his excellent record and that he is an Apprentice Jockey.
