Decision:

In our view having considered the films and the evidence at length the charge of careless riding was found proved.

Penalty:

Mr Tinsley is suspended from riding from the close of racing on Saturday January 17th up to and including racing on Friday January 23rd– three riding days. Gore (22/1/15) was not included as the committee was not satisfied that Mr Tinsley would have been riding at that meeting. In addition he is fined the sum of $500. The penalty imposed enables Mr Tinsley to fulfil his engagements on Wellington Cup day as the committee believed that the carelessness demonstrated on this occasion did not warrant Mr Tinsley foregoing engagements on that day.

Facts:

Following the running of Race 3, G Bristol & Sons R65 1200m, an information was lodged by Mr N Goodwin alleging a breach of Rule 638(1) (d). The information alleged that Mr Tinsley allowed his mount HINYUEN PALADIN to shift inwards in the back straight and cause a check to LANZARA (K Myers) when not clear.

Mr Goodwin read out the careless riding rule. Mr Tinsley acknowledged he understood the nature of the charge and confirmed that he did not admit the breach.

Submissions for Decision:

Mr Goodwin asked Mr Whiterod to show the films of the incident. Soon after the start and approaching the first bend there was a line of three horses, with HINYUEN PALADIN the widest runner, LANZARA to its inside and FANCY NANCY closest to the rail. The film paused at this stage showed all three horses had clear racing room between them. As they went into the bend HINYUEN PALADIN shifted in when not clear of LANZARA forcing Ms Myers to take a hold of her mount and check. Mr Whiterod said there was no movement outwards from FANCY NANCY. The side-on film showed that Mr Tinsley was not the required distance clear of LANZARA when he moved inwards.

Mr Goodwin said Mr Tinsley was trapped three-wide and seeking a run closer to the running rail. He asked the committee to notice Mr Tinsley’s arm movements which showed him pushing his horse and trying to go forward. Mr Goodwin conceded that Mr Tinsley did try and relieve the pressure but it was too late, whereas if he had gone an extra couple of strides forward the interference would not have happened.

Mr Tinsley defended the charge of careless riding on the basis that his horse was the cause of the interference, not that he had ridden carelessly. His explanation to the committee was based around the galloping action of HINYEUN PALADIN on the point of the bend when the horse changed legs and moved diagonally inwards. Mr Tinsley did not dispute that LANZARA was checked as result of HINYEUN PALADIN’s movement but said Ms Myers mount was racing slightly erratically and when she called to him he did attempt to pull his horse out. He continued to ride forward in an attempt to relieve the pressure.

Reasons for Decision:

The Committee had careful regard to all of the submissions and evidence placed before it by both the Stewards and Mr Tinsley.

The incident was quite straightforward. Mr Tinsley’s horse moved inwards on the bend and caused a check to Ms Myers' mount. We had to consider whether Mr Tinsley did enough, as the rider, to correct its line of running and thereby prevent the interference suffered by Ms Myers. Mr Tinsley approached the bend from a three-wide position and the films showed him looking to his inside many times prior to this. He was clearly looking to get a run closer to the rail and was aware of the two horses to his inside. The side on view showed Mr Tinsley was not the required 2 lengths clear of LANZARA when he allowed his horse to move inwards and any corrective action that he took was too late to be effective. In our opinion it was reasonable to expect a higher duty of care from an experienced senior rider.

Submissions for Penalty:

Mr Goodwin said Mr Tinsley’s record was excellent and he was not often before the stewards. He was suspended for four days for careless riding at Trentham in December last year but prior to that it had been over a year since any other careless riding charge. Mr Goodwin said today’s breach was a minor one.

Mr Tinsley said that he had a commitment to ride PURE CHAMPION on Wellington Cup day and it would be unfair to miss that ride due to a suspension on a very minor case of careless riding.

Reasons for Penalty:

In coming to a decision on penalty the committee took into consideration the submissions of both parties. Any penalty imposed must be appropriate for the degree of carelessness demonstrated. The stewards classified it as a minor case of careless riding and the committee agreed with that assessment noting that Mr Tinsley merely cut the corner a little bit fine. LANZARA was inconvenienced only briefly and it was accepted that Ms Myers' horse was racing keenly at the time. The record shows that this was only Mr Tinsley’s second careless riding breach in the last 18 months and it was our opinion that he should be given substantial credit for that.
