Facts:
It was alleged that Licensed Jockey A Browne, made a celebratory gesture prior to passing the winning post, in the concluding stages of the Hospitality New Zealand Canterbury 125th Grand National Hurdles.
Mr Browne was the rider of Gargamel, the winner of Race 8. About one stride from the winning post, Mr Browne "stood up" in the stirrups and raised his arm in a celebratory manner. The evidence was clear from the video coverage of the finish.
Mr Browne candidly admitted that he committed a breach of the rule.
Submissions for Penalty:
Mr McIntyre said that from the Stipendiary Stewards' perspective, the breach was at the lower end of the scale, as it occurred so close to the winning post. He said that Mr Browne had a clear record and submitted that a fine of between $150 and $200 should be imposed.
Reasons for Penalty:
Mr Browne was some 4 & 1/2 lengths clear at the finish of the race. He has a good record. No other horses or riders were inconvenienced by his gesture.
The Penalty Guide for Judicial Committees provides for a starting point of $300 in terms of a fine. Even though this was a Prestige Jumping Race, we do not think it necessary, having regard to the fact that the breach of the rules was at the lower end of the scale, for there to be any form of upwards adjustment to the starting point. We take the view that because the breach occurred so close to the finishing post and because of Mr Browne's good record that a discount of $100, on the starting point, can be allowed.
