Decision:

As Mr Castano admitted the breach we find the charge proved.

Penalty:

Accordingly, we impose a suspension on Mr Castano which will commence after racing on 31st May 2012 and conclude after racing on 13th June 2012 (5 days).

Charge:

Following race 4, an information was filed pursuant to Rule 638(1)(d). The informant, Mr Williamson, alleged that Mr Castano permitted his mount BULLION to shift inwards near the 950 meters when not sufficiently clear of ROSE OF RIO which was checked and forced into the line of FACE THE SUN with DANZA LAD, ANDREAS and BOMBELLA also all being hampered.

Facts:

Mr Oatham demonstrated the incident by using all the available films. He pointed out to the committee at the 950 metres Mr Castano allowed his mount to move in when only a bare length clear. This resulted in 4 runners on his inner all receiving varying degrees of crowding which in turn caused them to be hampered. Mr Oatham did explain that the field contained inexperienced horses.

Mr Castano in admitting the breach told the committee that he simply was trying too hard to make a good impression on the trainers that had supported him.

Mr Tiley advised the committee that Mr Castano is a very inexperienced rider. He further stated that he would be spending some time with Mr Castano to develop his riding skills.

Submissions for Penalty:

Mr Williamson produced Mr Castano's record which showed no previous breaches of this rule in the last 12 months. He submitted that the level of carelessness was 'mid range noting that several runners were affected by Mr Castano's inward movement. He reminded the committee that Mr Castano was an inexperienced rider, prior to today he had ridden in 18 tote races. Mr Williamson said Mr Castano was very co operative during the investigating and submitted an appropriate penalty would be a minimum 5 days.

Mr Castano informed the committee that he had no commitments over the next 7 days and was seeking his suspension to start after racing today.

In response to a question from the committee Mr Castano conceded that he rides only in the upper North Island region.

Reasons for Penalty:

The committee carefully considered all the evidence and submissions presented. The mitigating factor is Mr Castano admission of the breach and his very good record from a limited opportunity. However, this has to be balanced against the level of carelessness which we assess as mid range, with notable interference to several runners. We acknowledge that Mr Castano does ride only in the upper North Island region therefore this is reflected in the penalty.
