As Mr Muniandy has admitted the charge it is therefore deemed to be proved.
Penalty:
Mr Muniandy is suspended from race riding for three days commencing on 4th February and ending at the conclusion of racing on 18th February 2012.
Charge:
It was alleged that Mr Muniandy made insufficient effort to keep his mount from shifting in passing the 1000m crowding "Confused" across the line of "Bacco" which had to be checked.
As Mr Muniandy is an apprentice jockey, he was accompanied in the hearing by Mr M McCann, Licensed Trainer.
Facts:
Mr Ray showed the incident which gave rise to the charge on two views of the video coverage, from the back straight camera and from the side-on camera.
Approaching the 1000m point, Mr Muniandy was racing in a "comfortable" three-wide position with adequate room for two horses on his inside. However, Mr Muniandy then elected to move across the line of "Confused" which in turn went across the line of "Bacco" which received a check as a consequence. The check to "Bacco" was clearly visible on the side-on camera view. The video coverage also showed quite clearly that Mr Muniandy was not his own length and another length clear when he moved across.
Submissions for Decision:
Mr Ray submitted that Mr Muniandy's actions whilst being careless that the degree of carelessness was at the low to medium end of the scale.
Mr Muniandy, with Mr McCann's assistance, said that the horse in front of him eased the pace, and that accordingly he elected to go on the inside of the horse he was following, to avoid heels, when the better choice would have been to go to the outside.
Reasons for Decision:
Mr Muniandy was not his own length and another length clear when he moved from a three-wide position to a two wide position, with a resultant check to "Bacco".
Submissions for Penalty:
Mr Ray told the hearing that Mr Muniandy was a busy rider in the South Island but has two previous breaches of this rule in the past 12 months, on 23rd April 2011 and on 27th November 2011 for 2 days on each occasion. He also said that Mr Muniandy was always co-operative with the Stipendiary Stewards and conducted himself in a professional manner.
Mr Muniandy did not have any submissions to make on the question of penalty but did apply for a deferment of the coming into effect of any period of suspension as he has riding engagements at Riccarton on 1st February and at Dunedin on Saturday 4th February 2012.
Reasons for Penalty:
As a general rule, a suspension of 5 days is the starting point for the imposition of penalty. Against that we are obliged to take into account aggravating and mitigating features. As this is Mr Muniandy's 3rd breach of this rule in the last 12 months, that is an aggravating feature which justifies an uplift of 1 day, making the period of suspension, 6 days.
However, against that we take into account Mr Muniandy's co-operation with the Stipendiary Stewards and his professional manner, and his early admission of the charge. We also note that the degree of carelessness was at the lower end of the scale with no serious impact on the other horses affected by Mr Muniandy's carelessness. That allows us to discount the penalty by three days.
Mr Muniandy's application for deferment is granted. The period of suspension will come into effect at the conclusion of racing on Saturday 4th February and will end at the conclusion of racing on Saturday 18th February 2012.
That will encompass meetings at Invercargill on 9th February, Riccarton Park on 15th February and Invercargill on 18th February 2012.
