Decision:

Rule 648(3) allows for no discretion therefore we order that BLOOD BROTHA be disqualified from Race 2. Amended placings are: 2 PENTATHLON, 5 CARLOW, 7 MICHELIN, 4 MR CORBOY, 6 TEDDYTWINKLETOES. Dividends and stake money are ordered to be paid on amended placings.

Facts:

Following the running of Race 2, Fasttrackinsurance Chalmers Two Mile Premier, the Stewards requested a ruling in relation to Rule 648(3) in that BLOOD BROTHA weighed in light by way of Apprentice S McKay failing to draw the correct weight of 62.5kgs and that accordingly the Stewards request that BLOOD BROTHA be so disqualified.

648(3)
If, on being weighed in, a Rider cannot draw the proper weight (meaning thereby the weight allotted by the Handicapper for his horse to carry and adjusted only by any re-handicap, by having been declared overweight, by penalty or by authorised allowance) the Clerk of the Scales shall allow such rider 0.5 kg and if the allowance is not sufficient to enable the proper weight to be drawn then subject to sub-Rule (4) of this Rule then in addition to any other penalty which may be imposed the horse shall be disqualified for the Race.

Mr Oatham stated that Mr McKay was down to carry 62.5kgs as the rider of BLOOD BROTHA. He claimed 2kgs for his apprentice claim and 1kg was added for his safety vest therefore his actual weigh- out weight was 61.5kgs.

Upon weighing in he was found to be 60.5kgs, a full kilo underweight.

The Committee heard from Mr Tapp, Clerk of the Scales, who confirmed that Mr Mckay had weighed in 1 kilogram under his correct weight.

Reasons for Decision:

We were satisfied by the evidence put before us that Mr McKay weighed in 1 kilogram under the carded weight.
