As a result of Mr Johnson's admittance of the breach the Committee thus find the charge proved.

Penalty:

Mr Johnson was fined the sum of $250.00.

 

Charge:

An information (5768) was lodged by Stipendiary Steward Mr M Davidson under rule 330(3)(b) alleging Mr C W Johnson allowed himself to be engaged for two mounts named THE GLITZY ONE and FIORANO.

The rule reads:

" a rider shall not permit himself to be engaged for more than one horse accepted or deemed to have been accepted for the same race."

Mr Johnson admitted the breach and did not wish to be present at the hearing.

Facts:

Mr Davidson stated that the evidence in the earlier hearing information (5767) was an accurate record.

Mr Davidson had told the Committee that Miss Middlewood (acting on Mr Johnson's behalf) had effectively taken two rides, THE GLITZY ONE and FIORANO in the listed Riverton Cup and despite having him contacted all those concerned in the matter that a solution could not be found to resolve which horse Mr Johnson would be riding.

Submissions for Penalty:

Mr Davidson stated that the Riverton Cup was a listed race and one of significance on the Southern racing circuit.

Mr Davidson also stated that Miss Middlewood had taken the full responsibility and blame for the dual bookings and that Mr Johnson had very little input in the discussions or acceptance of the rides on the two horses THE GLITZY ONE and FIORANO.

Mr Davidson also told the Committee that Mr Johnson had a clear record under this rule from the 1st August 2012 and that he was an extremely busy and successful rider both in the South and North Island.

There were no submissions from Mr Johnson.

Reasons for Penalty:

In fixing penalty the Committee took into account that Mr Johnson was well removed from the process of the dual booking (this was confirmed by Miss Middlewood’s total admission of fault).
