Facts:

Following the running of Race 2 Stewards charged Mr May (MRS WASHINGTON) with a breach of careless driving (r869 (3) (b)) in that he caused interference to LE POLE DANCER with 1200 metres to run. Mr May admitted the charge and appeared at the hearing.

Mr Ydgren, with the use of the video replays, pointed out the relevant positions of both runners prior to the incident. Ms Haley stated that LE POLE DANCER was leading in the home straight with MRS WASHINGTON improving three wide from the rear of the field. When MRS WASHINGTON reached the parked out position Mr May attempted to go forward and take the lead. However, he was not sufficiently clear of LE POLE DANCER when crossing to the lead, resulting in interference to LE POLE DANCER which broke from its gait before settling three back on the pole line.

Mr May stated he had originally intended to sit MRS WASHINGTON in the parked out position. He believed Mr Davis was giving him the lead but as he shifted over LE POLE DANCER got keen and over raced which contributed to the incident. However he admitted he was not sufficiently clear of that runner.

Submissions for Penalty:

Ms Haley said Mr May had an excellent record with no previous breaches of the rule over the past 12 months. The interference was mid-range with LE POLE DANCER losing its position and affecting its chances. She sought a suspension of two days.

Mr May preferred a suspension as opposed to a fine.
