As the breach was admitted the Committee found the charge proved.

Penalty:

Mr Asano is suspended from the end of racing at Riccarton on the 26th January up to and including Riccarton on the 8th February 2020 (8 days).

Facts:

Mr Asano faced two charges arising out of his ride in race 5.  The first charge related to an incident shortly after the start when Mr Asano allowed his mount EASY ON THE EYE to cross over sharply causing interference to several runners.

Mr Oatham stated that from a wide barrier draw Mr Asano shifted inwards at speed when not clear of UPHOLD (C Barnes). Miss Barnes was forced to take a hold and check and in doing so was forced inwards crowding PHYLLITE, CO PILOT and EXCLAIM at about the 950 metres mark. He said while there was no contact between EASY ON THE EYE and UPHOLD, Miss Barnes thought she may have clipped a heel when restraining her mount.

Mr Asano stated EASY ON THE EYE was a bit green and he had attempted to keep off UPHOLD. He said he did hear Miss Barnes calling to him.

Mr Carston believed several of the runners looked to have over-reacted to EASY ON THE EYE’s inwards movement.

Submissions for Penalty:

Mr Davidson said Mr Asano had two previous charges under this rule at Egmont on the 12th October and more recently at Timaru on the 28th December. He had been suspended for five and seven days respectively. He viewed the interference as being mid to high range and sought a suspension. Mr Asano was the leading jockey and a very busy rider nationally.

Mr Asano submitted that he had declared rides at Riccarton on the 26th January. He did not seek a deferment of penalty.

Reasons for Penalty:

Mr Asano has shifted inwards from a wide barrier position shortly after the start when not clear of UPHOLD (C Barnes). Miss Barnes was forced to take a hold and check and, in so doing, was forced inwards crowding PHYLLITE, CO PILOT and EXCLAIM. It was an angled run at speed which caused interference to a number of horses.

Mr Asano has two previous charges inside four months, the most recent less than a month ago. We view the interference as being at the high end of mid-range and take a starting point of nine days suspension. We give credit of one day for his guilty plea.  Despite the two previous breaches of this rule, we regard the respondent’s record as a neutral factor, having regard to the frequency with which he is riding.
