As the breach was admitted we find the charge proved.
Penalty:
Accordingly, after taking all the above into account and under the provision of rule 1106 (2) we impose a suspension on Miss Collett from riding in races which is to start after racing on 31 March and conclude after racing on 5 April 2012 (4 days).

Facts:
Following race 5 an information was filed pursuant to rule 638(1) (d). The informant, Mr Oatham alleged that Miss A Collett permitted her mount PERFECT WARRIOR to shift outwards near the 1300 metres when not sufficiently clear of SHIQUAN (Mr J Waddell) which was hampered and checked.
Submissions for Decision:
Mr Coles demonstrated the video films which showed PERFECT WARRIOR racing on the rail approaching the 1300 metres. Mr Coles pointed out to the committee Miss Collett moving out to a one off position when only 1 to 1 ½ lengths clear of SHIQUAN. This caused Mr Waddell to ease his mount and lose his rightful position. Mr Coles said Miss Collett made no attempt to take a hold before moving out.
Miss Collett said she thought she was closer to the heels in front of her than the films showed and this was her reason for moving out.
Mr McKee said it was clear that Miss Collett did not make an attempt to maintain her line before moving out.

Mr Oatham produced Miss Collett’s record which showed 4 suspensions in the last 12 months. He submitted her carelessness in this charge was at the low end although Mr Waddell had to give up his rightful position.
Miss Collett said she had commitments up to and including 31 March and she rode throughout the country.
Reasons for Penalty:
The committee carefully considered all evidence and submissions. In mitigation Miss Collett has admitted the breach and her record for the number of rides she has is a reasonably good one. However, these reasons must be balanced against the aggravating factor of the check received by Mr Waddell. Miss Collett was obviously not the required distance clear when moving out. The committee finds Miss Collett’s carelessness at the low end.
