Charge:
An information was lodged under rule 869(4)6(b)(c) after the running of race 10 Caduceus Club of Southland 4YO Stakes Mobile Pace alleging that with approximately 30 metres to run B D McLellan (Poacher) shifted ground outwards forcing Hitthegroundrunning (S Walkinshaw) over extra ground.
Mr McLellan admitted the breach.
Facts:
It was agreed by all parties present that the statements made in information A5986 a protest hearing were an accurate record and that no further evidence by either parties was required.
Submissions for Decision:
Mr Allison stated that it was clear from the protest hearing that a breach had occurred.
Mr McLellan stated that it had been a simple error of judgement in a split second decision that he made.
Reasons for Decision:
The Committee was satisfied that Mr McLellan had pushed out forcing Hitthegroundrunning over extra ground at the 1300 metre mark.

Mr Allison stated that Mr McLellan was a Senior Horseman and had no previous record under this rule in the past twelve months and in fact had a very clean record throughout his driving career.
Mr Allison believed the breach was at the lower end of the scale.
Mr Allison did state that the connections of Poacher had lost the second place stake money of $2672.00 which was significant.
Mr McLellan stated that he had simply made an error of judgement and offered no further submission.
