As Mr Riddell admitted the breach we found the charge proved.

Penalty:

The Committee took into account Mr Riddell’s upcoming riding commitments and accordingly suspend his license from the close of racing on Sunday May 13th up to and including racing on Friday May 25th.

Facts:

Following the running of Race 7 (Leo Mumford Memorial Mdn), an Information was lodged by Mr D Balcombe alleging a breach of Rule 638(1) (d) in that J Riddell (NOT USUAL PRINCE) angled his mount out near the 350m tightening MAUNA KEA.

Although we had watched the films during the protest hearing the Committee requested they be played again to reflect the fact we were now addressing a charge of careless riding.

Mr Goodwin said Mr Riddell “allowed” his mount to shift out as he came around the turn. He emphasised a clear distinction between a rider angling their mount out, as opposed to allowing them to move out. On this occasion Mr Riddell allowed his mount to run wide on the turn and Mr Goodwin said that he could have done more to straighten its line of running. Mr Parkes received a sharp bump and became momentarily unbalanced as a result of the interference.

Mr Riddell explained that as he came around the turn in front, he was dictating the line of running. He admitted coming out a bit too far but said in his opinion Mr Parkes was attempting a marginal gap to his outside. Mr Riddell also questioned whether or not Mr Parkes mount shied away a little from his whip. Mr Riddell said he believed he was on the same angle rounding the bend as Ms Hemi was when Mr Parkes pushed up between them. He said that Mr Parkes was riding competitively and conceded that he would have done the same thing.

Submissions for Penalty:

Mr Balcombe submitted that Mr Riddell’s carelessness was below mid-range. He presented his record under the careless riding rule for the past 12 months:
21/1/18 - Waikato 5 days
24/2/18 - Matamata 7 days
3/3/18 - Auckland 5 days
29/3/18 - Wanganui 5 days

Mr Balcombe said the Stewards were seeking a suspension in line with the submissions and suggested a penalty in the vicinity of 6-7 days.

Reasons for Penalty:

The Committee considered all of the submissions presented. We assessed Mr Riddell’s degree of carelessness to be in the low-mid range. The films showed him coming around the bend on a diagonal angle when he had the option to stay closer to the fence. Mr Riddell explained that this was the natural pattern of the day’s racing. While this may be so, a rider must not take the line of another horse, unless clear to do so. Mr Parkes was well established in the gap when Mr Riddell came out further than he should have, causing tightening to Mr Parke’s mount. A protest followed which highlighted the fact that Mr Riddell’s actions had caused enough interference to warrant an enquiry.

We adopted a seven day starting point.

Mr Riddell’s record is a significant aggravating factor. Four careless riding charges spread over a 12 month period would not necessarily be considered unusual for a busy rider however five since January 2018 is now of concern. Mr Riddell said he is not proud of this record. Taking into account Mr Riddell’s admission of the breach, the level of carelessness and his only fair record it is our opinion that an eight day suspension is an appropriate penalty.
