Facts:

An information lodging a protest into race 7 alleged that horse 8 Chocolate Brownie had caused interference to horse 11 Flashman at the start of the race.

The judge’s placings were

1st 1 Zutano
2nd 14 Alien Waits
3rd 6 Benromach
4th 8 Chocolate Brownie
5th 13 Supper Waltz Wilson
6th 10 Meyer Lansky

The owner/trainer’s representative Mr R Lawson endorsed the information indicating that the protest was not contested.

Rule 869 states….

(4A) ‘No horse shall do anything which interferes or is likely
to interfere with any other horse or its progress’

Mr Muirhead referred to film coverage of the standing start Race 7 and identified horse 8 Chocolate Brownie (D Butcher) outside on the front row and horse 11 Flashman (T Mitchell) in barrier position 3 from the 20 metre mark

Immediately after the start Chocolate Brownie galloped and ran in onto the line of Mr Mitchell’s horse effectively extinguishing that horses chances.

The stipendiary stewards sought the disqualification of Chocolate Brownie.

The protest was not contested.

Reasons for Decision:

It was clear that Chocolate Brownie broke shortly after the start and in doing so ran into the path of and interfered with Flashman.
