As the breach was admitted we find the charge proved.
Penalty:
After taking all the above into account and under the provisions of rule 1106 (2) we suspend Mr McDonald from riding in races which is start after racing on 18 February and conclude after racing on 24 February 2012 (4 days).

Facts:
Following race 8 an infomation was filed pursuant to rule 638(1)(d). The informant Mr J Oatham alleged that Mr McDonald permitted his mount BARBADINE to shift in passing the 150 metres when not sufficiently clear of HIACE (Miss N Collett) which was taken in forcing SAVANAH RUSH (Mr C Ormsby) into the line of MON'SCALPE which was checked.
Submissions for Decision:
Mr Coles demonstrated the video films which showed BARBADINE (Mr J McDonald) moving in at the 150 metre mark. This caused HIACE to have its line dictated and in turn force SAVANAH RUSH into the line of MON'SCALPE which had to be checked. Mr Coles conceded that Mr Coleman and Mr Cameron had initially contributed to the crowding but Mr McDonald had finished it off at a stage when he was free of those runners by moving in when insufficiently clear.
Mr McDonald said Mr Coles had summed up the situation well but there were a lot of contributing factors in the incident outside his own control.

Mr Oatham said Mr McDonald had a very good record for the number of rides he has with 2 suspensions in New Zealand in the last 12 months and 3 in Australia. He conceded this incident was complicated with several mitigating factors and submitted Mr McDonald's carelessness was at the low end of the scale.
Mr McDonald said he had confirmed commitments up to and including 18 February.

The committee carefully considered all evidence and submissions as presented. In Mr McDonald's favour are his admission of the breach and his very good record. The committee finds this breach to be at the low end of carelessness as other riders had contributed to the interference.
