Under the provisions of Rule 632(2), the Committee declared FARM BOY to be a starter and the Judge’s placings shall stand.
Facts:
Following the running of Race 7, Mr M Williamson, lodged an Information requesting a ruling in relation to Rule 632(2) to determine whether FARM BOY gained an advantage with the gate opening early.
Rule 632(2) states "If, in the opinion of the Judicial Committee, any horse gained an unfair advantage by its barrier stall malfunctioning and opening, or being forced, by such horse, open prior to the starter effecting a start, such horse may be declared a non-starter".
Submissions for Decision:
Mr Williamson identified on the video footage that FARM BOY’s barrier stall opened slightly early. However, he was of the view that no advantage had been gained. He added that he would let the Committee determine the outcome.
Mr Moody accepted that FARM BOY’s barrier stall did open fractionally early. He said there was no mechanical issue with the barrier stalls.
Ms Thornton said that FARM BOY anticipated the start and made contact with the front of the barrier stalls. She said as a result FARM BOY got back on its heels as the barrier stalls opened.
Reasons for Decision:
The Committee carefully considered the submissions presented and reviewed the video footage frame by frame. The head on video footage showed that FARM BOY’s head made contact with the front of the barrier stall. As a result that barrier stall opened a small fraction earlier than the other stalls. It was clear that despite the stall opening a fraction early FARM BOY began on level terms with the rest of the field. Accordingly, we were satisfied that no unfair advantage had been gained.
