The Committee ruled that PRINCE OZ was denied a fair start and ordered that the horse be declared a non-starter.
Facts:
Following the running of Race 3, the Three Valleys Sales Draft Dash 1200m, an information was filed by Stipendiary Steward, Mr J McLaughlin, requesting a Ruling under Rule 632(1) as to whether PRINCE OZ, ridden by K Kwo, should be declared a non-starter due to being denied a fair start.
Rule 632 91) provides as follows:
If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-starter.
Submissions for Decision:
Mr McLaughlin, with the assistance of Stipendiary Steward, Mr M Davidson, showed back straight head on video replays of the start of the race, a 1200 metres event. He pointed out PRINCE OZ, ridden by Mr Kwo, drawn the number 6 gate. He pointed out PRINCE OZ, who was being fractious in the stalls and had a barrier attendant up beside the horse. Mr McLaughlin said that the attendant had hold of PRINCE OZ’s near rein and was attempting to settle the gelding. He stated that, just prior to the start being made, PRINCE OZ dived his head down with the attendant still holding onto the rein and when the barriers were released, PRINCE OZ still had his head down and the attendant still holding the rein.
Mr Kwo, rider of PRINCE OZ, confirmed that the attendant had hold of the horse’s ear and rein and was still holding the rein when the barriers were released.
Mr McLaughlin submitted that PRINCE OZ was denied a fair start and requested that the horse be declared a non-starter.
Reasons for Decision:
The Committee was satisfied that PRINCE OZ had dived it’s head and the barrier attendant still had a hold of the near side rein as the barriers were released. We were also satisfied that this occurrence materially prejudiced the horse’s chances and therefore determined that PRINCE OZ was denied a fair start.
