Following the running of Race# 1 the Cup Day Saturday 24th January 2015 Mobile Trot, Stipendiary Steward Mr N Ydgren lodged an information alleging the 4th placed horse Love The Moment (G Lee) …broke in excess of 50m inside the final 200m and/or was Lapped On by Sunnivue Sadona when in a break over the finishing line.
The Protest was lodged under Rule 870 (3) and the alternative 870 (5).
Rule 870 (3) reads:
Any horse which breaks from its gait shall promptly regain its proper gait.
The relevant Regulation is:
Breaking Horses
(b) Any horse which breaks from its gait within the final 200m of any race and continues on in the break for a distance of more than 50m or greater, shall be in breach or Rule 870 (3) in that it has failed to regain its proper gait.

Mr Wallis, with the use of the videos, stated that in the home straight Love The Moment broke from its gait prior to the 50m peg and continued on in a break to the finish line. At the finish Love The Moment was Lapped On by the fourth placed horse Sunnivue Sadona.

Mr Ydgren stated that Mr Lee had viewed the films and did not contest the protest. He said Mr Lee had restrained the horse immediately but had not been able to return his horse to its proper gait at the line. Mr Ydgren stated the Stewards were seeking disqualification under Rule 870 (3), or relegation under Rule 870(5).
Reasons for Decision:
The committee viewed the videos and was satisfied that Love The Moment had breached Rule 870 (3) by breaking from its gait in excess of 50m inside the final 200m. Having established a breach of that Rule the committee did not need to consider the alternative breach of Rule 870 (5).
