Decision:

The Judicial Committee ordered the disqualification of ELEGANT SUN from fourth placing. Amended placings were now:

1st (1) MOTU CLAUDIA ROSE

2nd (6) DOCTOR ZHIVAGO

3rd (2) RABALA LADY

4th (8) RARANGI JEWEL

5th (4) BURT MUNRO 

The committee authorised the immediate payment of dividends in accordance with the amended placings.

Facts:

Following the running of Race 1 (Outback Trading Company Trot 2500m), Information 5064 Instigating a Protest was filed by Stipendiary Steward Mr S Renault.

It stated: "That horse number 9 placed 4th or its driver breached the provisions of Rule 870(3) and breaking horse regulations - Elegant Sun broke in excess of 50m over the final 200m of the race."

Rule 870(3) states: "Any horse which breaks from its gait shall promptly regain its proper gait."

The judge's placings were:

1st (1) MOTU CLAUDIA ROSE

2nd (6) DOCTOR ZHIVAGO

3rd (2) RABALA LADY

4th (9) ELEGANT SUN

5th (8) RARANGI JEWEL

Submissions for Decision:

Using the films, Mr Renault identified Mr Munro's drive, ELEGANT SUN, which was observed to break over the final stages of the race. Mr Renault identified the markers located in the home straight, and submitted that based on the placement of these markers at set distances; ELEGANT SUN had broke from its proper gait for approximately 70 metres. Mr Renault sought the disqualification of ELEGANT SUN from fourth placing.

After viewing the films, Mr Munro acknowledged that he did not contest the protest.

Reasons for Decision:

It was clear from the films, and by Mr Munro's own admission that ELEGANT SUN had broken over the final stages of the race, for a distance in excess of 50 metres.
