Breach of Rule 865(2) - Gear Notification
Facts:
Following the running of Race 8 an Information was lodged by Stipendiary Steward Mr BJ Van Kan against Trainer Mr I Small alleging a breach of Rule 865(2) in that Mr Small presented THE MAGIC to race without the notified Pull Down Blinds.
Mr Small advised this Committee that he admitted the breach and he was present at the Hearing.
Rule 865(2) provides:
“Every horse entered in a totalisator race shall be presented in the Assembly Area prior to the race in the same notifiable gear as that notified under Sub-Rule (1)”.
Mr Van Kan advised the Committee that the notified gear for THE MAGIC was that it would be wearing Pull Down Blinds. He said that it was presented in the Assembly Area without them.
Mr Small accepted that that was the case.

Mr Van Kan said that this matter was brought to the JCA Committee because of the number of previous breaches of this Rule. Mr Van Kan advised the Committee that this was the third breach of the Rule since the 20th of March 2011.
Mr Small acknowledged the number of breaches.
Mr Van Kan submitted that a fine of $200.00 was appropriate.
Mr Small accepted this.

The Committee considered the evidence and on the basis that this is the third breach by Mr Small since the 20th of March 2011 the Committee believes that the fine submitted by Mr Van Kan is appropriate.
