Accordingly after taking all the above into account we impose a fine of $250.

Facts:

Following race 2 an information was filed pursuant to rule 330 (3) (c).  The informant Mr J Oatham alleged that Mr L Innes failed to make the contracted weight for MIDNIGHT VAN DAMME in Race 2.

Submissions for Decision:

Mr Oatham told the committee that Mr Innes approached the stewards 15 minutes prior to race 1 to inform them he would be 1kg over the card weight of 54 kgs for his mount in race 2.  He was subsequently replaced by Mr M Du Plessis.

Mr Innes explained that his manager took the mount on MIDNIGHT VAN DAMME for him at 54 kgs.  The connections informed him they would be happy if he was 1/2 kg over this weight on race day.  Mr Innes had suffered from a cold all week and being midwinter he always had trouble shedding weight.  In answer to a question from the committee Mr Innes confirmed he agreed to take the ride at 54 kgs as he was aware he had a 1/2 kg allowance over the carded weight.

Submissions for Penalty:

Mr Oatham said this was Mr Innes' 3rd weight charge in the last 6 weeks.  However he said Mr Innes was not a natural light weight and conceded it was harder to lose weight in the winter months.  Mr Oatham did not consider this to be a serious breach and submitted a fine of $200 - $300 would be appropriate.

Mr Innes had nothing to add regarding penalty.

Reasons for Penalty:

The committee carefully considered all evidence and submissions.  Mitigating factors are Mr Innes' admission of the breach, his knowledge that he could ride at 1/2 kg over if necessary and that he had been suffering from a bad cold all week.  However this is his third charge in the last 6 weeks which must be reflected in an appropriate penalty.
