Facts:
Following the running of Race 5, the Tara Family Trust Handicap Trot, an Information was filed by Stipendiary Steward, Mr S Renault, against Open Driver, Mr CR Thornley, alleging that “Mr Thornley (YOUNG STRANGER) drove carelessly near the 200 metres when shifting outwards when not entitled to and contacting DON’T ROCK THE BOAT (O Thornley) which broke and lost its chance”.
Mr Renault confirmed Mr Thornley had admitted the breach and that he did not want to be present at the hearing.
Rule 869 provides as follows:
(3) No horseman in any race shall drive: -
(b) carelessly
Mr Renault with the assistance of Mrs Tibbs identified Miss O Thornley at approximately 300 metres shifting out from her mid field position forcing TRICK STAR wider and gaining clear racing room. Mrs Tibbs pointed to Mr Thornley who had taken a position inside Miss Thornley, shift outwards and contact DON’T ROCK THE BOAT (O Thornley) causing it to gallop. Mr Renault said Mr Thornley was not entitled to try and force a run as Miss Thornley had TRICK STAR outside and forward of her horse.
Submissions for Penalty:
Mr Renault said Mr Thornley had a clear record under this rule in the last 6 months. He said the Guidelines indicated a 10-drive suspension. He said Mr Thornley was driving mostly 2 times per meeting and in this case equated to a 5-day suspension which was the Stewards recommendation.
Mr Renault relayed Mr Thornley’s request to start any suspension immediately, therefore no deferment was required.
Reasons for Penalty:
The JCA penalty Guidelines for the rule provides a $500 fine or a 10-drive suspension.
In determining penalty, the Committee considered this to be a mid-range breach with an aggravating factor being a horse’s chances were extinguished. For this we uplift the penalty to 12 drives.
The mitigating factors are Mr Thornley’s good record and admission of the breach for which we can afford him a discount of 2 drives.
The Committee considered a 5-day suspension (10 drives) was an appropriate penalty in this case.
