Accordingly, both protests were dismissed and authorisation to pay dividends on the Judge's placings and stake money was approved.

Facts:

Following Race 3 (Go Racing Ian Paterson Memorial) a protest was lodged pursuant to Rule 642(1) by Mr P McKay alleging that horses number 2 (OWEN PATRICK) and 9 (PELOTON) or their riders placed first and second by the Judge interfered with the chances of horse number 10 (IRON EAGLE), placed 3rd by the Judge.

The information alleged interference in the home straight.

Judges placings were:

1st   OWEN PATRICK (2)
2nd  PELOTON (9)
3rd   IRON EAGLE (10)
4th   SINARAHMA (5)

The official margins were half a head and a nose.

Submissions for Decision:

At the commencement of the hearing, all available views of the final stages of the race were played and the relevant horses identified.

Mr McKay protested on the grounds that around the 200m mark his horse IRON EAGLE was squeezed for a run by OWEN PATRICK on the outside and PELOTON on the inside. He said there were 2 instances where IRON EAGLE suffered interference. The first was when the winner OWEN PATRICK moved inwards and pushed IRON EAGLE sideways followed shortly after by OWEN PATRICK rolling outwards causing further interference. Mr McKay said that once IRON EAGLE got through the gap, he really dived down trying to win, and would have done so free of interference.

Mr S McKay, the rider of IRON EAGLE, confirmed this was an accurate description of what had occurred.

The connections of PELOTON argued that the winner OWEN PATRICK caused the interference and their runner had nothing to do with it. There was no contact between PELOTON and IRON EAGLE with the interference coming from the outside horse OWEN PATRICK.

The connections of OWEN PATRICK admitted that their horse may have rolled inwards a little but said Mr McKay had every opportunity to get up and win.

For the Stewards Mr Oatham said that there was slight inward movement from both first and second-placed horses.

Reasons for Decision:

Rule 642(1) states:

If a placed horse or its Rider causes interference within the meaning of this Rule 642 to another placed horse and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first-mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.

The Committee, after considering all the submissions and reviewing the films, found that there was some outward movement from PELOTON and some inward movement from OWEN PATRICK. This resulted in IRON EAGLE being crowded, however, the Committee was not satisfied that this affected the placings at the conclusion of the race.
