As Mr Nolan has admitted the breach the Committee finds the charge proved.

Penalty:

Accordingly we suspend Mr Nolan's license to ride in races from after racing at Avondale on 23 January until after racing at Hastings on 29 January - 4 days.

Facts:

Following the running of Race 6, the FLEMINGTON FARM 1100 an Information was lodged by Mr Williamson alleging that Mr D Nolan had permitted his mount DAYTIME ROBBERY to shift inwards when not clear of DEEMA which had to steady passing the 800 metres.

Mr Nolan acknowledged that he understood the Rule and confirmed that he admitted the breach.

Rule 638(1)(d) states' A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless'

Mr McIntyre used the available films to demonstrate the incident. He identified Mr Nolan riding DAYTIME ROBBERY in a 3 wide position as the field approached the 800 metres mark. Mr Du Plessis, riding DEEMA, was inside him when Mr Nolan dropped back and shifted into the line of DEEMA as Mr Nolan attempted to obtain a one out/one back position. Mr McIntyre told the Committee that Mr Nolan had not been the required distance clear of DEEMA when he attempted to shift his mount inwards. As a result Mr Du Plessis was forced to restrain his mount and it was checked in the process.

Mr Nolan stated that he had nothing to add to what Mr McIntyre had told the hearing.

Submissions for Penalty:

Mr Williamson produced Mr Nolan's riding record which showed 2 suspensions of 4 days each within the past 12 months. He said he believed it was a reasonable record. He said it was clear that Mr Nolan had misjudged his place when he attempted to drop back to get a better position when there was insufficient room for him to do so. Mr Williamson said that the Stewards felt this incident was at the low end of the scale and that Mr Nolan deserved some credit for his admission. He added that the Stewards believed a 4 day suspension would be appropriate.

Mr Nolan said he would prefer to commence any term of suspension after racing at Avondale on 23 January.

Reasons for Penalty:

The Committee took into consideration the submissions of the parties and viewed the films of the incident. We agree with the Stewards that this matter was low end on the scale and take into account Mr Nolan's admission and his riding record.

We adopted 5 days suspension as a starting point as per the JCA Penalty Guidelines.  Given the above factors we believe a suspension of 4 days to be an appropriate penalty.
