As the breach was admitted we find the charge proved.
Penalty:
Accordingly, and under the provisions of rule 1106 (2), we grant Mr Hills a deferment of his suspension until after racing on 29 July 2015. He is suspended from after racing on that day, 29 July, until after racing on 7 August 2015 (5 North Island days).
Facts:
Following race 4, the Tavistock Syndicate Owners 2 YO 1000, an information was filed by the informant, Mr M Williamson. He alleged that near the 300 metres Mr M Hills allowed his mount to shift out when not clear of ANGEL VAN HAARLEM which was checked hampering RAPID RISE.
Rule 638 (1) (d) reads: a rider shall not ride a horse in a manner which the judicial committee considers to be careless.
Mr Coles demonstrated the video films pointing out IRDY'S GIRL (M Hills) racing directly behind AUSSIE EAGLE just passing the 400 metres. Mr Coles said there was no run available for IRDY'S GIRL to move out. However he said Mr Hills elected to angle out when not sufficiently clear which resulted in IRDY'S GIRL making contact with ANGEL VAN HAARLEM. He said the check to ANGEL VAN HAARLEM was quite a severe one but in mitigation said Mr Hills' mount did over react and laid on Miss Collett's mount.
Mr Hills admitted he had moved out but said his horse over reacted and skewed sideways making contact with ANGEL VAN HAARLEM.

Mr Williamson produced Mr Hills' record which showed 2 suspensions in the preceding 12 months, a record which Mr Williamson said was a reasonably good one. However, he said Mr Hills had gone for a gap which he should not have done. He added Mr Hills' carelessness was in the mid range while the resultant interference was in the mid to high range. He submitted a suspension of 5 to 7 days would be appropriate.
Mr Hills said he had commitments up to and including 29 July and he rode throughout the North Island.
Reasons for Penalty:
The committee carefully considered all the submissions and evidence as presented. Mitigating factors are Mr Hills' admission of the breach and his good record. However the committee has also to consider the degree of carelessness shown by Mr Hills in this charge. He showed little regard for the riders on his outside by angling his mount out when insufficiently clear and in doing so caused a severe check to ANGEL VAN HAARLEM. This resulted in ANGEL VAN HAARLEM moving out and hampering RAPID RISE. The committee assesses Mr Hills' level of carelessness as midrange and the consequence of the interference to be also midrange. We concede that Mr Hills' mount did not react kindly to the incident by moving out further than he intended. Normally the committee would impose a 6 day suspension for this type of breach but have given Mr Hills a reduction of 1 day for the manner in which the horse reacted. The committee is satisfied that Mr Hills rides throughout the North Island including industry days.
