Decision:

As the breach was admitted we found the charge proved.

Penalty:

Mr Holmes was told the starting point for a careless riding charge was now 5 days.  However because of the mitigating factors above we have reduced the penalty in this case to one of 4 days.

Accordingly we suspend Mr Holmes from riding in races which is to start after racing on 15 December and conclude after racing on 22 December 2010 (4 riding days).

Facts:

Mr Coles demonstrated the video films and pointed out to the committee AGAMEMNON (Mr P Holmes) shift in when not sufficiently clear of ICEFYRE (Miss S Spratt).  This occurred near the 150 metres when ICEFYRE was in third position but as a result of having to be steadied lost approximately one to one and half lengths. 

Submissions for Decision:

Mr Holmes in admitting the breach said he thought he was clear of Miss Spratt when moving in.  He believed the check to Miss Spratt was marginal and his mount just moved in under pressure.

Submissions for Penalty:

Mr Oatham said Mr Holmes had incurred only one charge in the last twelve months which was an excellent record.  However he said in this case Mr Holmes had moved in 3 horse widths and he had continued riding forward without taking any corrective action.  He submitted a 5 - 6 day suspension would be appropriate.

Mr Holmes said he had comnmitments up to 15 December and did intend to ride in the South Island after that.  It was confirmed by Mr Oatham that Mr Holmes often rode in the South Island.

The committee carefully considered the evidence and submissions.  In Mr Holmes' favour are his very good record and his admission of the breach.  However he clearly moved in 3 horse widths when not clear resulting in ICEFYRE losing its rightful line of running to the post.
