 As the breach was admitted the charge was found to be proved.

 Accordingly Mr Jones is fined the sum of $300.

Facts:

Following Race 5, the Group 3 Mills Reef Winery Trentham Handicap, an information was lodged by the Stewards alleging a breach of Rule 638(3) (b) in that B R Jones used the whip excessively on his mount MAPMAKER prior to the 200m.

Mr Jones began to use the whip as the field rounded the bend into the home straight. Mr Oatham played the head-on video in slow motion and counted the number of strikes from that point up until the 200m mark. Mr Jones using the whip in his left hand could be seen to hit his horse approximately 15 times and while there was some respite between strikes his whip use sat well outside the recognised guidelines.

Mr Jones admitted the breach and explained that while he was looking for the 200m mark he was primarily concentrating on riding his mount out to the line where he finished in 3rd place.

Submissions for Penalty:

Mr Neal said Mr Jones’ riding record showed a single charge in 2011 and considering the significant number of races Mr Jones has ridden in this was an excellent record. He asked the committee to take into account the status of the race and the fact that Mr Jones finished in 3rd place. The Stewards' submission was for a monetary penalty in the range of $250 - $400.

Mr Jones said he had been riding a very long time and asked the committee to take note of his excellent record over that time. He explained that he thought his horse “was gone” at the 600m but it went on to finish 3rd.

Reasons for Penalty:

The guidelines for whip use in New Zealand are well recognised and understood by riders. Prior to the 200 metres they are only permitted to use the whip for six strides and then they must ride hands and heels for six strides. Mr Jones used the whip approximately 15 times prior to the 200 metres however we note that these were not continuous strikes. Mr Jones did give some respite but it was certainly outside of what is considered acceptable. Taking into account Mr Jones’ admission of the breach, his record, the Group 3 status of the race, and other recent penalties we imposed a fine of $300.
