As Mr Lawson admitted the breach we find the charge proved.

Penalty:

The Committee accordingly imposes a fine of $150 on Mr Lawson.

Charge:

Following the running of Race 6, an information was lodged pursuant to Rule 507(2). The informant, Mr Muirhead alleged that Mr Lawson (Junior Horseman) broke his driving engagement on RUSSIAN ALSU when arriving to take his drive 5 minutes prior to start time.

Facts:

Mr Muirhead advised the Committee that Mr Lawson was not available to drive RUSSIAN ALSU until seven minutes prior to race start time. Mr T Mitchell, who had warmed up the horse, retained the official drive. Mr Muirhead pointed out to the Committee that every horseman should be available to take their engagement to drive a horse at least fifteen minutes prior to the race start time.

Mr Lawson advised the Committee that he actually arrived on course earlier in the day and decided to have lunch at the on course restaurant. This resulted in him not focusing on the start time of his driving engagements. He attempted to take his drive on RUSSIAN ALSU once he realised the time however, it was deemed by Mr Muirhead that he was too late.

Submissions for Penalty:

Mr Muirhead referred to the JCA Penalty Guide which provided for a starting point of $200. He acknowledged that Mr Lawson was a Junior Horseman and he had no previous breaches of this Rule.

Mr Mitchell submitted he had previously been fined $150 for a similar breach.

Reasons for Penalty:

The Committee carefully considered the evidence and submissions presented. The mitigating factors are, Mr Lawson is a Junior Horseman, his admission of the breach, his clear record under this rule. However, the aggravating factor is Mr Lawson was actually present on course and we consider he did not act professionally, breaking an engagement to drive RUSSIAN ALSU.
