As Mr Cameron admitted the breach the Committee found the charge proved.

Penalty:

The Committee grants a deferment to Mr Cameron’s suspension pursuant to Rule 1106(2).

Accordingly, Mr Cameron had his license to ride in races suspended for a period to commence after racing on 16 March and conclude after racing on 30 March 2019.

The race meeting at Waipa on 29 March is scheduled for Apprentice Riders only, therefore that date was not included in the penalty.

Facts:

Following the running of race 8, Bonecrusher NZ Stakes (Group 1), an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Oatham, alleged that Mr Cameron permitted his mount VIN DE DANCE to shift out near the 1100 metres making contact with RONDINELLA which was forced wide and hampered.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Cameron said that he understood the Rule and confirmed he admitted the breach.

Mr Coles demonstrated the incident using the available video footage. He identified that near the 1100 metres Mr Cameron turned his horse's head outwards and bumped RONDINELLA wider on the track.

Mr Cameron said that he misread the situation and misjudged his outward manoeuvre. He said that he planned to “niggle” RONDINELLA outward.

Submissions for Penalty:

Mr Oatham produced Mr Cameron's record which showed 2 previous breaches under this Rule in the last 12 months, he noted 1 of those breaches is to expire tomorrow. He said his record was very good for a busy rider who has had 683 rides in the last 12 months. He said the aggravating factors were the breach occurred in a Group 1 race worth $200,000. Mr Oatham described the level of carelessness as midrange.

Mr Cameron requested a 7 day deferment so he could fulfil his engagement for QUEEN OF DIAMONDS in the Group 1 NZ Oaks at Wellington on 16 March. He asked the Committee to take into account his admission of the breach and his very good record.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented.

The video films showed that near the 1100 metres Mr Cameron directed his mount outwards when not sufficiently clear of RONDINELLA. As a result that runner was bumped out wider on the track and lost its rightful running line. The Committee deemed the level of carelessness displayed by Mr Cameron was midrange.

The JCA Penalty Guide starting point for midrange carelessness is 8 days which was adopted.

The aggravating factors were the breach occurred in a Group 1 race with $200,000 stakes payable. Under the provisions of Rule 920(2) an uplift of 3 days was applied.

The mitigating factors were Mr Cameron’s admission of the breach and his very good record for a busy rider. For these collective factors he was afforded a 1 day reduction in penalty.

The Committee was mindful that Mr Cameron’s last day of suspension would include the Group 1 Manawatu Sires Produce Stakes race meeting.

After taking into account all the above factors the Committee considered that an appropriate suspension was 10 national riding days.
