Decision:

As Miss Wynne has admitted the breach, it is found to be proved. 

Penalty:

We accept that Ms Wynne is “chasing rides” in her endeavour to be the leading South Island apprentice this season and that she was intending to ride at as many meetings as she could before the end of the season and, in particular, for Mr Meyers at Rotorua and Awapuni. The penalty has to equate to 4 days’ suspension. Ms Wynne is suspended from riding at the conclusion of today’s meeting up to and including 25 July. This encompasses the meetings at Ashburton, Awapuni, and Otaki. She is thus able to ride at Rotorua on 26 July. She is also fined the sum of $400 and reminded of her obligations under the Rules of Racing.  

Facts:

Mr McLaughlin, stipendiary steward, alleged that Miss Wynne, apprentice jockey, allowed her mount MARGARITA MOVER to shift inwards when not clear of SNIPARINDA (Mr A Jagoo) resulting in SALU (Mr R Bishop) receiving a check.

Mr McLaughlin demonstrated on the videos that Miss Wynne, with 1000 metres to race, had shifted in towards the fence on her mount MARGARITA MOVER crowding SNIPARINDA and SALU, with the latter horse having to be restrained.

Ms Wynne stated she had not shifted in that much and pointed out that the rail, which was out 3 metres, had a small outwards kink at the relevant point of the track. She also stated that SNIPARINDA was over-racing at the time there was a clipping of heels.

Ms Collett, who was assisting Ms Wynne, said she backed up Ms Wynne’s statement that there was not much movement. It was not a drastic inwards movement. She pointed out that SNIPARINDA was over-racing and described the respondent’s degree of carelessness as being minor.

Submissions for Penalty:

Mr McLaughlin produced Ms Wynne’s record, which he described as only fair. He noted she had had 4 suspensions this season: 3 days on 22 August; 5 days on 8 November; 5 days on 14 January; and 3 days on 17 May. Ms Wynne confirmed this record was correct.

Mr McLaughlin stated that the respondent was a South Island rider who rode occasionally in the Central Districts. He submitted that she should be treated as a South Island rider and accordingly the starting point should be 3 days, with an upgrade for the respondent’s poor record. He agreed the movement from Ms Wynne was only slight but she had kept coming across when not clear. Mr Jagoo’s mount, SNIPARINDA, was going freely, he said, when there was the clipping of heels. He believed a 4-day suspension was required.

Ms Wynne stated she was chasing rides in an attempt to be the leading South Island apprentice. She said she was intending to ride for Mr Myers at Rotorua and Awapuni in the next 2 weeks. She asked that these days be counted in any suspension. Mr McLaughlin resisted the day at Rotorua being counted, as Ms Wynne had no record of riding on that course.

At the Committee’s request Mr McLaughlin endeavoured to speak to Mr Myers. He was unable to do so, but spoke to Mr Myers’ daughter who confirmed that the stable wanted Ms Wynne to ride at Rotorua and Awapuni.

Reasons for Penalty:

Ms Wynne has no recent record of riding in the Central Districts, as she accepts. We intend to treat her as a South Island rider. On that basis we take a starting point of 3 days. We view the breach as being at the lower end of mid-range. We do not accept that it is a minor breach of the careless riding rule. Mr Bishop very clearly has had to take a strong hold of SALU due to Ms Wynne’s actions. Having regard to this fact and the respondent’s poor record, although we note this needs to be viewed in the context that she is a busy South Island apprentice, we would uplift the starting point to a point between 4 and 5 days. When a discount is given for Ms Wynne’s admission of the breach, we reach a penalty of 4 days’ suspension.

Mr McLaughlin has said that he accepts the Awapuni day can be taken into account in the calculation of penalty but not Rotorua. He believes no fewer than 2 South Island days need to be included in the calculation. These 2 days would be Ashburton and the first day of the Grand National meeting at Riccarton. Ms Wynne has a ride in the Winter Cup, which is the first day of the Grand National meeting. She thus has asked that the Committee consider a suspension and a fine.
