As Ms Williams admitted the breach, the Committee found the charge proved.

Penalty:

Ms Williams was fined $300.

Facts:

Following the running of Race 6, the ILT Ascot Park Hotel Southland Guineas (Listed Race), an Information was filed with the Judicial Committee. The Informant, Mr Davidson, alleged that Ms Williams made a celebratory gesture prior to the winning post.

Ms Williams acknowledged that she understood the Rule and confirmed her admission of the breach.
Rule 638(2) provides:

A Rider shall not make a celebratory gesture prior to her horse passing the winning post.

Mr McLaughlin demonstrated the incident using the available film replays. He identified Ms Williams and her mount (GLOBAL THINKING) and showed that she made a celebratory gesture just before the winning post.

Ms Williams acknowledged that she made a celebratory gesture prior to the winning post. She thought she’d made the gesture on the line, adding that she was only marginally wrong with her timing.

Submissions for Penalty:

Mr Davidson said that Ms Williams had a clear record under the rule. He said that the JCA Penalty Guide specified a $300 fine as a starting point. Mr Davidson submitted that a $300 fine was appropriate in this case. He said Ms Williams had admitted the breach at the earliest opportunity and had only just misjudged the timing of her gesture by half-a-stride.

Asked to comment on what she considered to be an appropriate penalty, Ms Williams said she agreed with the penalty submission made by Mr Davidson.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented.

The JCA Penalty Guide recommends a starting point for a breach of this Rule is a $300 fine.

The Committee believes a $300 fine is appropriate in this case. Ms Williams has an excellent record and admitted the breach at the first opportunity. The Committee also takes account of the breach occurring very close to the winning post and, despite the fact this was a Listed race, does not believe there should be any increase in the starting point set down in the JCA Penalty Guide.
