Facts:
Following the running of race 8, Fibre Fresh New Zealand Thoroughbred Breeders’ Stakes Group 1, an Information was filed pursuant to Rule 638(2). The Informant, Mr Oatham, alleged that Mr Grylls made a celebratory gesture prior to passing the winning post when riding VIADANA.
Mr Grylls acknowledged that he understood the nature of the charge, the Rule and admitted the breach.
Rule 638(2) states: A rider shall not make a celebratory gesture prior to his horse passing the winning post.
Mr Oatham demonstrated on the video film that Mr Grylls made a celebratory gesture two to three strides prior to the winning post. He said the signage which was close to the winning post may have given Mr Grylls a false illusion.
Mr Grylls told the Committee that when he was clear in the lead the final few strides of the race became a “blur” due to the status of the race.
Submissions for Penalty:
Mr Oatham submitted that Mr Grylls had a clear record under this Rule. He described the celebratory gesture as being “not terribly extravagant” and assessed the breach as low end. Mr Oatham noted the breach occurred in a Group 1 race. He said previous celebratory gestures had attracted fines ranging from $100 to $350. Mr Oatham submitted a fine in the $200 to $300 range would be appropriate for today’s breach.
Mr Grylls submitted that he had a clear record under this Rule and believed the celebratory gesture was at the low end. He acknowledged that a fine would be an appropriate penalty.

The Committee carefully considered all the evidence and submissions presented. The mitigating factors are Mr Grylls' admission of the breach, his clear record under this Rule and we assess the celebratory gesture as low end. We note the incident occurred in a Group 1 race and the Rule is in place for safety reasons which are paramount.
The Committee referred to the JCA listing of penalties for similar breaches which showed a $250 fine would be an appropriate penalty for today’s breach.
