Facts:

Mr Hope was charged with a breach of r 869 (2), in that he used his whip more than permitted under the Use of the Whip Regulations, when driving MELODY POND in race 2.

Mr Renault, with the use of the videos, stated MELODY POND challenged three wide for the lead entering the home straight and raced several lengths clear of the field. He said Mr Hope was observed to strike his horse 12/13 times from the 400 metres to the finish.

Mr Hope stated MELODY POND was new to the stable and had a reputation of not running out her races. He said once she reached the lead she had tried to pull up and he had urged her on with the reins. He admitted he had miscounted the use of the whip. Mr McIlwrick stated that Mr Hope had held the reins in both hands.

Mr Renault produced Mr Hope’s record. He had 226 drives last season and 52 this season. He had an excellent record and this was his first breach of the Whip Regulations. He sought the mandatory fine of $200. 

Reasons for Penalty:

The breach is at the low end. The mitigating factor is MELODY POND clearly shortened stride and attempted to pull up and Mr Hope was caught in the unenviable position of having to urge his horse on, and in doing so breached the Regulation. A fine at the lower end of the scale is appropriate.
