Accordingly, Mr Bosson had his license to ride in races suspended for a period to commence after racing on 13 January and conclude after racing on 20 January 2019.
17 January at New Plymouth was not included in Mr Bosson’s penalty because it is scheduled for Apprentice Riders only.
Facts:
Following the running of race 3 Maara Grange Rehabilitation Facility 1400, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Jones, alleged that Mr Bosson permitted his mount THE WHITE QUEEN to shift in passing the 1100 metres when insufficiently clear of PATCH MAN which was checked.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Bosson said he understood the Rule and confirmed that he admitted the breach.
Mr Williamson demonstrated the incident using the available video footage. He identified that PATCH MAN had to be steadied when placed in restricted room when moving onto the course proper near the 1200 metres. He said this was due SHACKELTONS EDGE shifting out which made contact with PATCH MAN. As a consequence that runner then raced fiercely.
Mr Williamson said the above incident occurred prior to Mr Bosson allowing his mount to shift in when only a bare length clear of PATCH MAN passing the 1100 metres. As a result that runner was crowded and checked.
Mr Bosson admitted that he allowed his mount to shift in when insufficiently clear which resulted in PATCH MAN being crowded and checked. He said the incident was made to look worse than it was because PATCH MAN seemed to have a “soft mouth “. He said that each time Mr Elliot tried to ease PATCH MAN the horse got its head up.
Submissions for Penalty:
Mr Jones produced Mr Bosson’s record which showed 1 previous breach under this Rule in the last 12 months. This being on 26 October 2018 which incurred a 5 day suspension for low range careless riding. He said Mr Bosson misjudged the distance when shifting in passing the 1100 metres. He acknowledged that the racing manners of PATCH MAN contributed to the incident. He described the level of carelessness as low range.
Mr Bosson said that he was booked for MELODY BELLE in a Group 1 race on 19 January. He asked the Committee to consider imposing a 3 day suspension and a big fine so he could ride on 19 January. He said that his record was good and he had admitted the breach. He advised that his proposed suspension could start after racing on 13 January 2019.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented.
The Committee did consider Mr Bosson’s request for a 3 day suspension and a big fine so he could ride MELODY BELLE in a Group 1 race on 19 January.
The importance of Iconic / Premier upcoming meetings should be in the forefront of jockeys’ minds, causing them to be even more determined not to breach the Rules.
In our opinion there were no compelling or exceptional circumstances placed before us to merit a combined penalty in this case.
To impose a 3 day suspension and a big fine would be inappropriate and inconsistent with other penalties imposed on riders throughout the country.
When reviewing the incident the Committee observed that PATCH MAN was over racing prior to Mr Bosson’s inward shift. We found that Mr Bosson allowed his mount to shift in 1 horse width when only 1 length clear of PATCH MAN passing the 1100 metres. We observed that Mr Bosson looked to his inside prior to shifting ground and we accept that the racing manners of PATCH MAN exaggerated the incident. Mr Bosson did attempt to relieve some of the inward pressure but the check to PATCH MAN had already occurred. The Committee deemed the level of carelessness displayed by Mr Bosson was low range.
The JCA Penalty Guide starting point for low range carelessness is 6 national riding days which was adopted.
There were no aggravating factors.
The mitigating factors were Mr Bosson’s admission of the breach and his good record. For these collective factors Mr Bosson was afforded a 1 day reduction in penalty.
After taking into account all the above factors the Committee considered that an appropriate suspension was 5 national riding days.
