After viewing the videos and hearing the evidence the breach was found proved.

Penalty:

Mr Purvis’ Junior Horseman’s Licence is suspended for three days from the completion of racing today up to and including the 17th July at Ashburton. The three days include Forbury Park HRC (14th), NZ Metro (15th) and Ashburton TC (17th).

Facts:

Following the running of race 6, the Changeover Junior Drivers Mobile Pace, an information was lodged by Stipendiary Steward Mr S Renault against Mr M Purvis, alleging a breach of Rule 869 (3) (b), in that Mr Purvis “…allowed Cool CHANGES to strike the sulky wheel of MICKEY JAY (J Morrison) passing the 1400m.”

Rule 869 (3) (b) reads:

No horseman in any race shall drive: carelessly.

Mr Purvis admitted the charge and was assisted at the hearing by Mr J Dunn.

Mr Renault stated that Cool Changes settled at the rear of the field and trailing Mickey Jay. Approaching the 1400m mark Mr Purvis angled Cool Changes out to improve three wide. He alleged that when shifting outwards Mr Purvis allowed his horse to strike the wheel of Mickey Jay. He said that at the moment of impact Mr Morrison looked downwards at his wheel. The sulky tyre of Mickey Jay deflated and Mickey Jay was later retired from the race.

Mr Dunn stated Mr Purvis had made a misjudgement when easing his horse out to improve.

Submissions for Penalty:

Mr Renault stated Mr Purvis was a busy Junior Horseman with 130 plus drives last season and over 120 drives this season. He had admitted the breach at the outset and had cooperated fully with the Stewards. However, he had a previous careless charge at Methven in March for a similar offence. On that occasion Mr Purvis was suspended for 2 days. As this was Mr Purvis’ second breach of the rule within 120 days he was seeking a suspension of three days.

Mr Dunn stated that Mr Purvis had made an error of judgement. He added the mitigating factor with the incident at Methven was when the pace eased suddenly and Mr Purvis’ horse had struck a wheel. This was confirmed by both Mr Purvis and the Stewards. Mr Purvis indicated he preferred a suspension. He was not seeking a deferment.

Reasons for Penalty:

After hearing the submissions the Committee took into account Mr Purvis’ admission of the breach and that the offence was one of misjudgement. As it is Mr Purvis’ second charge within 120 days the recommended three day suspension is appropriate.
