As Mr Lammas admitted the breach the Committee find the charge proved.

Penalty:

Accordingly, Mr Lammas had his license to ride in races suspended for a period to commence after racing on 13 May and conclude after racing on 20 May 2015 (3 days).

Facts:

Following the running of race 11, Battersby Funeral Services, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Mr Lammas allowed his mount LABELS to shift outwards near the 300 metres into the line of KATORIE (A Collett) which clipped a heel and blundered.

Mr Lammas acknowledged that he understood the nature of the charge, the Rule and confirmed his admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Coles identified that rounding the final turn all riders were getting towards the outside of the track. He said when Mr Lammas let his mount shift out a horse width he got into the line of KATORIE which resulted in that horse clipping a heel and blundering. He said Mr Lammas made an error of judgement on this occasion. He identified on the films that just prior to the incident KATOIRE did lay in when following LABELS.

Mr Lammas told the Committee that his mount was not handling the track and he made an error when allowing it to roll out. He added that he was not aware Ms Collett was racing directly behind him.

Submissions for Penalty:

Mr Williamson produced Mr Lammas’ record which showed 1 previous breach under this Rule in the last 12 months which incurred a 4 day suspension. He said Mr Lammas has a very good record and described the carelessness as very low end. He submitted a suspension at the low end including all North Island dates would be appropriate.

Mr Williamson was able to produce Mr Lammas’ recent riding history. This showed that Mr Lammas has recently ridden in the Central Districts Industry days on several occasions.

Mr Lammas advised that he had upcoming engagements at Te Awamutu on 13 May, and sought a deferment to any proposed suspension. He had nothing further to add.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. The Committee have adopted 5 riding days as the starting point in considering the term of suspension for this careless riding charge. The mitigating factors were Mr Lammas’ admission of the breach, the level of carelessness was very low end and his very good record in relation to this Rule.

The Committee was satisfied that Mr Lammas has a recent history of riding in the Central Districts on Industry days and this was reflected in penalty.

The significant mitigating factors in this particular case justifies a reduction in penalty to 3 days.
