Mr Ydgren, stipendiary steward, alleged that Mr W Low shifted his drive wider on the track near the 1100 metres forcing ACE MOMENT wider on the track.
Facts:
Mr Ydgren demonstrated on the videos that Mr Low when driving NO GO SLOW BRITON had moved from the rail to two wide and, in so doing, had pushed Mr Curtin driving ACE MOMENT three wide on the track. He said the respondent had explained that he had mistaken the 1200 metre marker for the 1000 metre one.

Mr Ydgren produced the respondent’s record, which was clear under this rule. He said Mr Low had had 26 drives last season and 17 thus far this season. He submitted a fine of $200 was appropriate.
Reasons for Penalty:
This is a clear breach of the push out rule. Mr Low’s outwards movement is not marginal, but this is explained by his mistaking the markers. We give credit for his good record and admission of the breach.
