As Ms Hemi has admitted the breach, we find the charge proved.
Penalty:
Accordingly, Ms Hemi is suspended for four days, from the conclusion of racing on Saturday 18 February 2017 until the conclusion of racing on Sunday 26 February 2017.

Facts:
Following the running of Race 8, the Sheet Metalcraft Invercargill Gold Cup, an information A7796 was lodged by Mr M Davidson under r 638(1)(d) (careless riding) in that apprentice jockey, Ms Hemi, permitted her mount LA NOUVELLE VAGUE to improve into a run which had not fully developed near the 800 metres, resulting in THE GORDONIAN (G Jogoo) being checked and SUREASYOUWEREBORN (T Moseley) being hampered.
Stipendiary Steward, Mr Tidmarsh, used the video to highlight the incident. Ms Hemi, LA NOUVELLE VAGUE, was travelling behind Ms Barnes, OOR WULLIE, which was a “loose” two out from the rail. On the bend about the 900 metres, Ms Hemi shifted inside Ms Barnes’ horse, which caused tightening and checked Mr Jogoo. Ms Barnes’ horse was racing to the outside of the leading horse.
Mr Davidson added that the prudent run for Ms Hemi was to follow Ms Barnes. The gap might have been present for a stride or two, but not on a bend as horses tend to step back in on exiting the bend.
Ms Hemi stated that Ms Barnes was two and half horse widths off the rails, and had then gone to three horse widths off. As a consequence, she had elected to improve into the gap on the point of the turn, where her horse rolled in.
Mr Callaway stated that as Ms Hemi travelled up, a half gap appeared on the point of the turn, which did not help the situation.
Submissions for Penalty:
Mr Davidson submitted that Ms Hemi has an extremely good record: 283 rides so far this current season; one warning for this charge in the past 12 months; and more than two years since a suspension.
Mr Davidson further submitted that Ms Hemi is a Central and Southern rider. This incident was mid range but could have been a lot worse than the check that Mr Jogoo had received.
Ms Hemi was given time to leave the room to make enquiries as to her upcoming riding engagements. On her return she did not seek a deferment of her suspension.
Reasons for Penalty:
In coming to a decision on penalty the Committee adopted as a starting point a 5-day suspension, as per the JCA Penalty Guide. Aggravating factors were that the stake for the race was $40,000 and the breach was towards the upper end of mid range. There was never a gap that Ms Hemi could safely move into at that point of the bend. Ms Barnes was never three wide. This took the starting point to 6 days.
The mitigating factors are Ms Hemi’s early admission of the breach and her excellent riding record for a busy apprentice jockey. We deduct two days.
