Decision:

The breach is admitted and therefore the charge is proved.

Penalty:

The Committee orders that Ms Spratt's License to ride in races is suspended from the conclusion of racing on the 3rd of December 2017 until after the conclusion of racing on the 17th of December 2017.  (10 National riding days).

Facts:

After the running of the ASHFORD LODGE 2YO STAKES (a Listed Race) an Information was lodged by Senior Stipendiary Steward Mr M Williamson against Class A rider Ms S Spratt alleging that Ms Spratt allowed her mount KAILANI SUNSET to shift in when not sufficiently clear of MELT (Rider M McNab) which was dictated in crowding LITE MY CIGAR (Rider D Johnson) and FROSTED (Rider M Cameron) who were both checked losing ground.

Ms Spratt was present at the Hearing and she acknowledged that she understood the Rule and she confirmed her admission of the breach.

Rule 638(1)(d) states: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Stipendiary Steward Mr A Coles demonstrated the incident by use of the race films and showed where Ms Spratt's horse jumped from gate 5 and the films showed that she angled her horse across as she was heading to the front of the field. On her inside were FROSTED, LITE MY CIGAR and MELT. Mr Coles said that Ms Spratt was barely a length clear of the other horses and that as a result of her inwards movement the 3 horses on her inside were checked and FROSTED and LITE MY CIGAR were badly checked. He showed that the incident happened about 100 metres after the start. Mr Coles also said that Mr McNab's horse was inclined to lay in and that there could have been a contribution from the horse outside Ms Spratt. He described the carelessness as low end.

Ms Spratt said that she thought she had sufficient room to cross. She said that she had considered defending the charge on the basis that Mr McNab could have made a better effort in restraining his horse and that he contributed to the incident.

She acknowledged that she was not sufficiently clear and she has admitted the breach.

Submissions for Penalty:

Mr Williamson referred to Ms Spratt's record which showed 4 breaches of this Rule in the last 12 months. She incurred penalties of 4 days suspension on the 10/12/2016, 4 days on 29/01/2017, 5 days on 01/11/2017 and 5 days on 21/11/2017.

He asked the Committee to take into account that this was a 2yr old Stakes Race and Owners were looking for Black Type for their horses.

He said that the riders inside Ms Spratt were trying to maintain their positions as they are entitled to do and that FROSTED and LITE MY CIGAR had suffered severe interference. He then said that the actions of Ms Spratt were in the low to mid range and then corrected that to more the mid range. He said that the consequences of her actions were in the high range.

He submitted that a mid range suspension was appropriate.

Ms Spratt did not really have anything further to add.

Reasons for Penalty:

The Committee carefully considered and reviewed the evidence from the parties. In particular we reviewed the films several times and noted that as a result of the incident FROSTED was pushed into the running rail.

The race films clearly showed the inwards movement by Ms Spratt and that she was not sufficiently clear of the inside runners. The interference to FROSTED and LITE MY CIGAR was so severe that they lost at least 6 to 7 lengths and their chances in the race were extinguished.

We do not accept that there was any contribution from any other horses or their Riders. We have treated Ms Spratt's record as being fair only although we did tell her that we were concerned that she had breached this Rule in a very similar manner twice in 4 days. We did not uplift the starting point penalty because of her record but we did consider doing so. The above matters are all aggravating.

The only mitigating matter for Ms Spratt is that she has admitted the breach.

We assess the totality of the incident to be in the mid to high range of seriousness and for that we adopt a starting point penalty of 9 days. We have given Ms Spratt a credit of 1 day for her admission of the breach but we have also uplifted the starting point because this is a Listed Race.

Ms Spratt is about to commence a term of suspension from the conclusion of racing on the 26th of November 2017 to after the conclusion of racing on the 3rd of December 2017 and any suspension we impose will commence after that.

Taking all of the above matters into account the Committee believes that a term of suspension of 10 National riding days is appropriate.
