Amateur Horseman J Nigro driving BLUEGUM MOTEL SHINES came to the starting gate out of position at three on the second line instead of two on the second line.
Facts:
Mr Muirhead showed the video film of the incident. BLUEGUM MOTEL SHINES came to the starting gate three on the second line instead of position two. Immediately after the start Mr Nigro moved the horse into the one out position. Mr Muirhead said the starter had called out to Mr Nigro to position his horse correctly.
Mr Nigro said there was a scratching on the second row, he was confused and did not hear the starter call out.
Submissions for Penalty:
Mr Muirhead said Mr Nigro was an amateur driver and this was his first breach of the rules. He said the offending was mid range and submitted that the recommended starting point penalty of $250 be imposed.
Mr Nigro asked for the smallest fine possible.
