Facts:
Following Race 2, an Information was lodged against Licensed Graduation Driver, Miss H Clarke, alleging a breach of Rule 869(2) in that she used her whip on more occasions than is permitted under clause b of the Whip Regulations, inside the final 400m.
Miss Clarke confirmed that she admitted the charge and understood the rule and Whip Regulations concerned.
Mr Renault gave evidence to show that Miss Clarke driving NADIRA FRANCO, was positioned midfield and 2 wide as the field was entering the straight, inside the 400m. He pointed out Miss Clarke use the whip on 13 occasions prior to the line.
Miss Clarke did not dispute the number of strikes.
Submissions for Penalty:
Mr Renault stated that Miss Clarke had a clear record in relation to this Rule and submitted that a $200 fine as per the Sliding Scale of penalties for a first offence of 11-13 strikes, be considered as penalty.
Reasons for Penalty:
The JCA Penalty Guide provides a $200 fine, mitigation inclusive, on the sliding scale, for a first offence where 11 to 13 strikes were administered. There were no aggravating factors to consider, therefore no uplift in penalty was warranted.
We therefore determined that a $200 fine was an appropriate penalty in this case.
