Following the running of Race 2 (J SWAP Contractors Ltd 1600), Information No. A12926 was filed with the Judicial Committee. It was alleged that Ms Newman used her whip excessively on TUNZAGUTZ prior to the 100m.
Ms Newman said that she understood the Rule, the Charge and confirmed that she admitted the breach.
Ms Algar showed the film replays and said that Ms Newman struck her mount 8 times with the whip prior to reaching the 100m. She added that it was 3 times more than is permitted under the Rules (5 only).
Ms Newman and Mr Harris agreed that the whip had been used 8 times.
Submissions for Penalty:
Mr Jones produced Ms Newman’s record which showed a prior breach of the Rule on 25 July 2020 when a fine of $300 was imposed. Mr Jones placed the whip use towards the lower-end.
Mr Harris said that it was not aggressive use of the whip.
Ms Newman did not comment.
Reasons for Penalty:
The JCA Penalty Guide starting point for a second breach of the Rule is a fine of $500.
Taking all matters into consideration the starting point was deemed to be an appropriate penalty.
