Facts:
At the conclusion of race 5 The Otautau Railway Hotel and Otautau Sports and Social Club Handicap, an information 5770 was lodged by Stipendiary Steward Mr M Zarb requesting the Judicial Committee determine if NAVIGATOR (R Bishop) should be declared a non-starter as he was being held as the barriers opened.
The rule reads
If in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a race owing to a mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), The Judicial Committee may declare such horse to be a non starter.
Submissions for Decision:
Mr Zarb showed the Committee several video clips of the alleged incident; highlighting NAVIGATOR (R Bishop) leaving the starting stalls very slowly, some two or three lengths from the rest of the field.
Mr Zarb also highlighted the position of the starter’s assistant who was in the stall of NAVIGATOR prior to and at the start of the race.
Mr R Bishop stated that NAVIGATOR had his head down in the stalls just prior to the start, and that he yelled ‘wait, wait’ to the starter, as his horse was not ready.
Mr Bishop also stated that a starter’s assistant had held his horse prior to putting its head down, Mr Bishop confirmed Mr Zarb’s comment that his horse lost two or three lengths because of its slow start.
Mr K Price (Official Starter) said he had not heard Mr Bishop yell out, and that he was unaware that his horse may have been in difficulty.
Miss S Bray (Starters Assistant) said she had held the horse by the ear to wait, the horses head had gone down , Mr Bishop had yelled to the starter , and she had then tried to pull the horses head up, with her arm extended.
Reasons for Decision:
The Committee was satisfied that NAVIGATOR was denied a fair start. The head on video clip clearly shows Miss Bray's arm extended, in front of Mr Bishop as the gates opened, with the horse settling two to three lengths behind the second last horse.
