As Ms Nicholas admitted the breach the Committee found the charge proved.
Penalty:
The Committee grants a deferment to Ms Nicholas’ suspension pursuant to Rule 1106(2).
Accordingly, Ms Nicholas had her license to ride in races suspended for a period to commence after racing on 13 March and conclude after racing on 21 March 2020.
Facts:
Following the running of race 4, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Oatham, alleged that Ms Nicholas allowed JUSTA BOY BULLSEYE to shift in when not clear of WILLIAM TELL which was checked and steadied near the 100 metres.
Ms Nicholas acknowledged that she understood the Rule and confirmed her admission of the breach.
Mr Harris and Mr Campbell assisted Ms Nicholas at the hearing.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Coles demonstrated the incident using the available video films. He identified that JUSTA BOY BULLSEYE was racing 1 off the fence in 3rd place near the 1000 metre mark. Shortly after that point Ms Nicholas allowed her mount to shift in when a bare length clear of WILLIAM TELL. As a result, that runner was checked and its rider had to take a hold of his mount.
Ms Nicholas said that she misjudged her inward shift and the amount of room that was available.
Mr Harris said that it was Ms Nicholas' first ride on the Ellerslie track and when she shifted in WILLIAM TELL over reacted.
Mr Campbell said that he agreed with the Stewards and Mr Harris and reiterated the point that Mr Calder, the rider of WILLIAM TELL may have over reacted when his mount was checked.
Submissions for Penalty:
Mr Oatham said that Ms Nicholas has a clear record from 14 race day rides as an Apprentice. He described the level of carelessness to be in the mid-range and submitted the breach occurred in a $50,000 race on a Premier race day. He submitted in keeping with those factors was sought.
Ms Nicholas advised that she had engagements on 13 March and any proposed suspension to start after that date. In terms of penalty Ms Nicholas asked the Committee to take into account that she is still getting used to riding in “tight quarters”.
Mr Harris said that Ms Nicholas needs to be more selective in the choice of her mounts particularly accepting rides on Premier days given her lack of current experience. Mr Campbell accepted this fact.

The Committee carefully considered all the evidence and submissions presented.
When reviewing the video films, it was evident that Ms Nicholas permitted her mount to shift in 1 horse width when only 1 length clear of WILLIAM TELL. As a result, that runner was checked and we noted that WILLIAM TELL did not react well when restrained by its rider.
The level of carelessness displayed by Ms Nicholas was deemed to be low to mid-range.
The JCA Penalty Guide starting point for low to mid-range carelessness is 7 national riding days which we adopted.
The Committee considered Ms Nicholas' record to be a neutral factor.
The mitigating factor was Ms Nicholas’ admission of the breach for which she was afforded a 1-day reduction in penalty.
After taking into account all the above factors the Committee considered that 6 national riding days was an appropriate penalty.
