Decision:

 The charge of careless riding against Mr Bullard is dismissed. 

Facts:

Following the running of Race 8, the AWS LEGAL QUEENSTOWN CUP OPEN HANDICAP an information was filed by Stipendiary Steward Mr M Davidson, against Licensed Senior Jockey Mr J Bullard, alleging a breach of Rule 638 (1) (d) in that... passing the 400m J Bullard (Ric O’Shea) allowed his mount to shift outward causing Darci  Coup (A Morgan) to check and The Groomsman (J Morris) to be crowded. 

Mr Bullard was present at the hearing and indicated that he did not admit the breach.  

Submissions for Decision:

Mr Davidson demonstrated on the video the relevant positions of the horses as they approached the 600m mark. Darci Coup (Ms Morgan) was racing about three wide near the lead with The Groomsman (Ms Morris) on her inside. Mr Bullard (Ric O’Shea) mounted a run wide around the outside and approaching the 400m mark allowed his mount to shift inwards crowding Darci Coup. This inward movement forced Ms Morgan to check, she stood up in the saddle, with resulting crowding to The Groomsman on its inside. Mr Davidson said the videos were the best they had of the incident and did not give a clear view of the incident.

Ms Morgan confirmed that evidence. She stated she had called out to Mr Bullard just prior to the check. However, Mr Bullard’s mount had crossed over in front of her, causing her to check and clip his heel.

Mr Bullard stated the videos did not give a clear picture of the incident. He said he moved in but did not believe he knocked her (Ms Morgan) over. He believed there were horses shifting outwards just prior to him crossing over that contributed to the incident. He said Mr Hannam (Soldier Of Love) had shifted outwards from the rails position and had shifted The Groomsman outwards onto Darci Coup. He also stated that Darci Coup appeared to panic when he moved up on its outside and that may have also contributed. Ms Morgan confirmed Darci Coup was better placed in clear racing room. 

Reasons for Decision:

After considering the evidence of the Stewards, Mr Bullard and Ms Morgan, and viewing the videos the committee found there was conflicting evidence concerning the incident of careless riding against Mr Bullard. The committee, while acknowledging that Mr Bullard did contribute to the incident, were not persuaded that the incident was solely due to Mr Bullard.
