Facts:
Prior to the running of Race 8 Information No.A12281 was filed with the Judicial Committee. It was alleged by the Informant that Mr Turner had been engaged for two runners in Race 8 (James & Son 1550) the horses being TIME BOMB (Trainer Mrs J Miller) and FOILING (Trainer Mr A Sharrock).
Rule 330(3)(b) provides:
A Rider shall not: permit himself to be engaged for more than one horse accepted or deemed to have been accepted for the same race.
Mr Turner had the Rule read and confirmed that he admitted the breach.
Mr Balcombe who had dealt with the matter in the lead-up to raceday said that on Wednesday last the Racing Bureau had contacted him and said that Mr Turner had been declared for both horses in the same race.
He said that Mr Turner’s name was removed from both horses and that he contacted Mr Turner and told him to sort it out with the Trainers involved. Mr Balcombe added that he had spoken to Mrs Miller the Trainer of TIME BOMB on Thursday last and she said that she was reasonably happy for Mr Turner to get off her horse but that she had been disadvantaged due to all of the senior riders having a ride in the race.
Apprentice Rider Ms D Hirini was the replacement Jockey for TIME BOMB.
Mr Turner for his part said that his Agent Mr A Neill had taken the ride on TIME BOMB and had not advised him hence the reason for the double booking in the same race.
Submissions for Penalty:
Mr Goodwin said that Mr Turner had a clear record under the Rule and recommended that a fine be imposed.
Mr Turner said that a fine would be a suitable penalty.
Reasons for Penalty:
The JCA Penalty Guide starting point for a first breach of Rule 330(3)(b) is a $200 fine. Taking all matters relevant to penalty into consideration the Committee determined that the starting point penalty would be an appropriate penalty.
