Mr Tidmarsh, Stipendiary Steward, alleged that Mr Hunter (ACOLYTE) used his whip excessively in the over the final 400 metres of race 9.
Mr Quirk, Stipendiary Steward, demonstrated on the videos that Mr Hunter used his whip 11 times in the home straight, before stopping some 50 metres from the winning post.
Mr Tidmarsh acknowledged there were pauses but stated there were too many strikes.
Mr Hunter said he was aware of the rule and knew he was “borderline”.

Mr Tidmarsh produced Mr Hunter’s record, which was clear this and last season under this rule. Mr Hunter has had some 260 drives in this time.
Mr Hunter asked that he be fined rather than suspended.

We adopt the $500 starting point in the JCA Penalty Guide. Mr Hunter’s breach is towards the lower end.
We give credit of $100 for each of the mitigating factors of the admission of the breach and the respondent’s record, which is excellent. That takes us to a penalty of a fine of $300.
