Charge:
Following the running of Race 1, Ashburton Trust Mobile Pace, an information was filed by Stipendiary Steward, Mr S P Renault, against Licensed Open Driver, Miss A L Jenkins, alleging that Miss Jenkins, as the driver of ARDEN’S SOUTHEE in the race, “used the whip excessively on ARDEN’S SOUTHEE in the run home”.
Miss Jenkins had signed the Statement by the Defendant on the information form indicating, firstly, that she admitted the breach and, secondly, that she did not wish to be present at the hearing of the information.
Rule 869 provides as follows:
(2) No horseman shall during any race:
(b) use his whip in an unnecessary, excessive or improper manner.
Facts:
Mr Renault showed a video replay of the final 300 metres of the race. He pointed out ARDEN’S SOUTHEE, driven by Miss Jenkins leading the field for home. He alleged that Miss Jenkins, from that point, used her whip on 21 occasions. That number was not disputed by Miss Jenkins, Mr Renault said. The first nine were with the reins still in her hand but she was still using the whip. The remaining strikes were full strikes, in a continuous manner, and with no discernible pauses, Mr Renault said. Such use of the whip was excessive, Mr Renault submitted.

Mr Renault informed the Committee that Miss Jenkins had a clear record as far as breaches of the whip Rule were concerned. She was not a “busy driver”, having had 36 drives in the current season to date. He submitted that a fine of $200 was appropriate in the circumstances.
Reasons for Penalty:
In arriving at penalty, the Committee took into account Miss Jenkins’ admission of the breach and her previous good record. The Committee was satisfied that a fine of $200 was an appropriate penalty having regard to those matters and to other fines imposed for excessive use of the whip in cases where the a driver had not previously breached the Rule and had admitted the charge.
